Continued use after such changes indicates your acceptance of the revised Terms.

2. Health and Medical Disclaimer

The content and features provided in the Service are for general informational purposes only and are not intended to diagnose, treat, cure, or prevent any disease or medical condition. Radia is not a substitute for professional medical or dermatological advice. Always consult with a qualified healthcare provider regarding any health-related or skin-related concerns. In a medical emergency, immediately dial 911 (or your local emergency number).

All skin analyses, routine recommendations, product suggestions, and progress assessments are automated approximations generated by artificial intelligence and may be incomplete, inaccurate, or unsuitable for your individual circumstances. The Company assumes no liability for adverse reactions, skin irritation, allergic responses, or any other harm arising from your reliance on the Service.

3. Account Registration and Eligibility

Account Creation: You may be required to register an account by providing accurate personal details (e.g., name, email address). You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

Age Requirement: You must be at least 13 years old. If you are between 13 and 17, a parent or legal guardian must review and agree to these Terms on your behalf and is fully responsible for all activity conducted using the Service.

Privacy: Your information will be used in accordance with our Privacy Policy.

4. Permitted and Prohibited Uses

When using the Service, you agree to abide by all applicable local, state, national, and international laws. Prohibited activities include, but are not limited to:

• Reselling, renting, or transferring any part of the Service

Any violation may result in the immediate termination of your account and access to the Service.

5. Protection of Minors

6. Grant of License

Radia grants you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms. All rights not expressly granted remain with Radia. By submitting content (including photos), you represent that you own or have rights to it and grant us the right to use it solely for the purpose of providing and operating the Service for you.

7. Use at Your Own Risk

Your use of the Service is entirely at your own risk. Although we strive to provide accurate and useful information, Radia does not guarantee any specific outcomes or improvements to your skin. You voluntarily assume all risks associated with using the Service and any actions taken based on its analyses or recommendations, including but not limited to risks of skin irritation or adverse reactions to recommended products.

8. Subscriptions and Billing

Access to certain features may require a paid subscription. Subscriptions are processed through third-party platforms (e.g., Apple App Store). Trial periods, if offered, will automatically convert to a paid plan unless you cancel at least 24 hours before the trial ends. Subscriptions renew automatically unless you disable auto-renewal in your device account settings.

All subscription payments are non-refundable except as required by applicable law. Please note that removing the app from your device does not deactivate your subscription.

9. Account Security

You are responsible for safeguarding your account credentials. Notify us immediately at radiaskinapp@gmail.com if you suspect any unauthorized access or breach. Radia is not liable for any losses incurred from unauthorized account use.

10. Disclaimer of Warranties

The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. Radia does not warrant that the Service will be uninterrupted, error-free, or secure, or that any skin analysis or recommendation will be accurate, reliable, or suitable for any purpose. No advice or information obtained through the Service shall create any warranty not expressly stated herein.

11. Limitation of Liability

In no event shall Radia or its affiliates, officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages—including, without limitation, loss of data, profits, or use, personal injury, skin damage, or adverse health outcomes—arising out of or in connection with your use of the Service. The total liability, if any, shall not exceed the amount you paid, if any, for accessing the Service in the twelve (12) months preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

12. Intellectual Property and Feedback

All rights in the Service (excluding your content) are owned exclusively by Radia or its licensors, including all text, graphics, logos, trademarks, software, algorithms, and models. You may not copy, modify, distribute, sell, or reverse engineer any part of the Service.

Your feedback is valuable to us. By providing suggestions or comments, you grant Radia a non-exclusive, royalty-free right to use and incorporate your feedback without any obligation to compensate you.

14. Indemnification

You agree to indemnify and hold harmless Radia, its officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable attorneys’ fees) arising from your use of the Service, your breach of these Terms, or your violation of any applicable law.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes arising from these Terms will be resolved by binding individual arbitration administered by the American Arbitration Association in the State of Delaware. You agree to resolve all claims on an individual basis and waive any right to a class or representative action. Either party may seek injunctive or equitable relief in a court of competent jurisdiction pending a final arbitration decision.

16. Termination and Survival

Radia reserves the right to terminate or suspend your account at its discretion, without liability. Upon termination, all rights granted to you immediately cease. Provisions regarding liability, warranties, indemnification, intellectual property, and governing law shall survive termination.

17. Modifications

Radia may update, modify, or discontinue the Service or any of its features at any time without prior notice. Your continued use of the Service after such changes constitutes your acceptance of the revised functionality.

18. Miscellaneous

Entire Agreement: These Terms, along with our Privacy Policy, constitute the entire agreement between you and Radia regarding the use of the Service.

Severability: If any provision is found to be unenforceable, the remaining provisions will remain in effect.

No Waiver: Failure to enforce any part of these Terms does not constitute a waiver of our right to enforce later.

Mobile Use: Standard data rates and fees imposed by your carrier may apply when accessing the Service on your device.
